Your access to and use of LankaGo Airport Taxi is subject exclusively to these Terms and Conditions. This Terms and Conditions presents the “General Conditions” applicable to the use of services offered by LankaGo Airport Taxi, either through the site LankaGo Airport Taxi, application software for mobile phone handsets (app), or phone (in addition to the “Website”). You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website, you are fully accepting the terms, conditions, and disclaimers contained in this notice. If you do not accept these Terms and Conditions, you must immediately stop using the Website and do not use it. These Terms expressly supersede prior agreements or arrangements with you.

License

Subject to your compliance with these Terms, LankaGo Airport Taxi grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to: (i) access and use the Applications on your personal device solely in connection with your use of the Services; and (ii) access and use any content, information, and related materials that may be made available through the Services, in each case solely for your personal, non-commercial use. Any rights not expressly granted herein are reserved by LankaGo Airport Taxi and its licensors.

The contents of LankaGo Airport Taxi’s website do not constitute advice and should not be relied upon in making or refraining from making any decision.

Change of Use

The Website is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, and accuracy.

In addition, LankaGo Airport Taxi makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the services or any services or goods requested through the use of the services, or that the services will be uninterrupted or error-free.

To the extent permitted by law, LankaGo Airport Taxi will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website, even if LankaGo Airport Taxi had been advised of the possibility of such damages.

LankaGo Airport Taxi does not guarantee the quality, suitability, safety, or ability of third-party providers. You agree that the entire risk arising out of your use of the services, and any service or good requested in connection therewith, remains solely with you, to the maximum extent permitted under applicable law.

LankaGo Airport Taxi makes no warranty that the functionality of the Website will be uninterrupted or error-free, that defects will be corrected, or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

LankaGo Airport Taxi’s services may be used by you to request and schedule transportation, goods, or logistics services with third-party providers, but you agree that LankaGo Airport Taxi has no responsibility or liability to you related to any transportation, theft, damage to property, goods, or logistics services provided to you by third-party providers other than as expressly set forth in these terms.

LankaGo Airport Taxi is not liable for theft, damage to goods or property, or criminal acts of drivers. In addition, LankaGo Airport Taxi shall not be vicariously liable for the acts of drivers or independent contractors under any circumstances.

1. RELATIONSHIP DRIVER-PASSENGER

LankaGo Airport Taxi provides transportation services by taxi/cabs, serving only as an intermediary commission agent outsourcing the taxi/cabs and registering drivers to optimize the scheduling service for the taxi. Thus, by accepting the provision of services by the TAXI DRIVER, the PASSENGER acknowledges that LankaGo Airport Taxi has no direct association with the TAXI DRIVER; it merely facilitates contact between the driver and passenger through the Mobile App for the Driver and Passenger to create bookings. The user acknowledges and agrees that LankaGo Airport Taxi is not liable for any act or omissions committed by any user, whether by robbery, breach of contract, or any other act, including the effective fulfillment of the obligations assumed by the users, and loss not being for tax purposes. The user acknowledges and agrees that, by registering and accepting the policy of the service, they do so at their total means and exclusive risk. LankaGo Airport Taxi recommends that every transaction is conducted with good sense.

You acknowledge that LankaGo Airport Taxi does not provide transportation or logistics services or function as a transportation carrier and that all such transportation or logistics services are provided by independent third-party contractors who are not employed by LankaGo Airport Taxi or any of its affiliates.

2. FROM AVAILABILITY AND INCONSISTENCY IN THE SYSTEM

• LankaGo Airport Taxi does not guarantee that the system will be available without any interruption and that it will always be error-free; therefore, it shall not be liable for damages caused to users.
• You agree that LankaGo Airport Taxi is also not responsible for any damages or losses caused to your computer as a result of using the Website.
• LankaGo Airport Taxi is not liable for any error or inconsistency of information with other independent systems specializing in service provision for GPS, radar, and similar technologies.

3. COMPENSATION FOR DAMAGES

• Users agree to indemnify and hold harmless LankaGo Airport Taxi and its representatives from any claims, suits, losses, liabilities, damages, and expenses, including reasonable attorneys’ fees and court costs for the damage they cause.
• Users agree to indemnify and hold harmless LankaGo Airport Taxi and its representatives from any accidental claims or suits that occur due to the driver’s negligence or fault. Therefore, users agree to indemnify LankaGo Airport Taxi and its representatives from any type of vicarious liability.
• Users accept that LankaGo Airport Taxi acts solely as a scheduling/matching service between its users and taxi drivers, and that it is not responsible for any issues that arise during the taxi ride, such as accidents, delays, or taxi discomfort.

4. OBLIGATIONS, LIABILITIES, AND RISKS OF PASSENGERS

The PASSENGER certifies that they use the service of their own free will and untrammeled choice and recognizes and accepts full responsibility and risk for using the Website.

4.1 The Acceptance and Refusal and Cancellation of Services

The acceptance and denial of the service may occur at first by the DRIVER, who can accept or deny the service when receiving a notification for a ride. The PASSENGER may cancel the contract for any reason. Both parties acknowledge that LankaGo Airport Taxi is not liable for any delays, cancellations, failure to cancel the contract, and miscommunication between the passenger and driver, nor for any delay or failure in the delivery of services from the DRIVER.

4.2 The Information and Risks of the Service

• The PASSENGER acknowledges and declares that they understand and are aware of all the risks involved in the use of the Website and contracting services, pledging to reasonably take care as expected of someone who chooses a taxi for transport.
• The PASSENGER acknowledges and agrees that LankaGo Airport Taxi performs no DRIVER selection; merely registering on their website to participate does not vouch for their suitability, legal compliance, physical fitness, or mental health to provide the Services. The PASSENGER acknowledges that the data provided by the TAXI DRIVER, such as (i) vehicle model, (ii) vehicle plate number, (iii) full name, (iv) profile picture, among others, were provided by the DRIVER or the TAXI COMPANY by themselves. By accepting the Services, the PASSENGER acknowledges that LankaGo Airport Taxi has no involvement in the contractual relationship between driver and passenger.
• LankaGo Airport Taxi may provide a claims processor or an insurer any necessary information (including your contact information) if there is a complaint, dispute, or conflict, which may include an accident involving you and a Third Party Provider (including a transportation network company driver) if such information or data is necessary to resolve the complaint, dispute, or conflict.

5. GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law principles.

6. ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between you and LankaGo Airport Taxi in relation to your use of the Website, and supersede all previous agreements in respect of your use of this Website.

7. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall remain in full force and effect.
